Disney in argument (lawsuit) about production items

According to numerous sources, Disney seems to be facing yet another day in court in the face of an injunction by VFX Rearden LLC.  The suit alleges that three prominent Walt Disney World titles: Guardians of the Galaxy, Avengers: Age of Ultron and Beauty and the Beast were filmed using stolen “performance motion capture” technology.This follows a successful court ruling in Rearden’s favor last year against two Chinese firms who they also claim used stolen equipment.   The equipment in question is a MOVA Contour system which they alleged was being licensed by Digital Domain 3.0)  Rearden argues that Disney reproduced and distributed the three films using this stolen technology.Rearden, LLC was self-funded by Steve Perlman who prior to setting up the company had worked with Apple an Microsoft.  Perlman claims to have been developing MOVA since 2006.  Its first use was in the 2008 film The Curious Case of Benjamin Button and it has been used in numerous films since.

 

In terms of supporting evidence,  Rearden claims to have amassed footage of members of the production teams of the above films either describing  or using what would appear to be the MOVA Contour system.  The suit then goes on to highlight projects where Disney was legally contracted to use the equipment including on Pirates of the Caribbean: On Stranger Tides, TRON: Legacy , The Avengers and John Carter.

The aim of lawsuit is to stop Disney’s distribution of the three films in question. Reardern, LLC. is also seeking damages and profits from copyright infringement.

 

Disney has yet to make a statement regarding the suit.
