I can see the resorts, and I can see not being able to have an annual pass, because you have names, and IDs, etc, etc. Yes, they've got cameras, in the parks, and security, BUT what is to stop trespassed Joe Bloe from forking out xxx number of dollars in cash, (or buying from a reseller, etc), and walking in the gate with a ticket. They don't get your name with an expiring ticket, and yes you have a finger scan, but use a different finger. I guess if you were ever caught, then at that point they could arrest you, but..... as vast as the property is, can they truly keep a person off the property. That's a good question. With this new direct to room stuff they're doing at some of the resorts, this guy could even stay at a Disney resort by having someone else make a reservation for him, and showing up and going direct to his room. If he uses cash for all of his purchases while on property, he's never going to be asked to show an ID. If he got caught, he would be arrested. For a misdemeanor. Here's something similar but non Disney My daughter and her boyfriend both work in the airline industry. He texted her while we were at the Fort. A passenger was a little tipsy in the terminal. One of the higher up agents came to talk to him, explained that they would let him board, but he would be denied further adult beverages while on the plane. He agreed and was very cooperative so he was allowed to board. You all know how this is going to go... While on board he starts acting up so the pilot asks for the police to be waiting when they land. Mr. Wonderful is escorted off in cuffs. They run his name, and he has an outstanding warrant for his arrest! So besides getting charged with a slew of Federal Crimes relating to airlines, he gets busted for his original warrant. But, despite their last name, contributions to a Go Fund Me are voluntary and you take your own risk about the validity of a person's need when you contribute. I guess I'm a little caught up in the fact that (as far as we know, which is nothing except what he and the news reports said so that is the basis for my opinion) he didn't hurt anyone -- run them over with a stroller, push them in line, get into a fight, actually have a meth lab or atomic bomb in his room, etc. or even take something that he wasn't entitled to (a dip in resort pool where he wasn't staying, smoking in the no-smoking zone) -- banning him from all parks/resorts for life seems like harsh punishment to me. I'm not arguing that he is entitled to any compensation from Disney in any way for what happened or that he's not completely hurting his own cause by looking for sympathy through social media. On one of our trips to the MK, my wife was talking to a former Disney Employee and they somehow got talking about injuries/claims, etc. He asked her if she had ever seen an multistoried office building over in the Downtown Disney area. He explained that it housed the Disney Customer Service people and the lawyers. He explained that if you had a beef with Disney/minor injury, you first dealt with the CS people on the first floor. They could give out meal vouchers, passes, etc. the small things to appease you. Next floor up was the senior CS agents. They got the people that stuck to their guns and didn't settle with the lower agents, and they can give out better "settlements".. Next floor were paralegals, above them were lower level lawyers. At the top were the big gun lawyers. He said that if you ever got as high as the two floors of lawyers, prepare for a major battle. Disney will examine your life with a fine toothed comb. Ever file a slip and fall claim anywhere in the US? They will discover it. Been in an auto accident, yup they know. Filed a claim against a restaurant or grocery store because you got "ill" from eating something, they will find it. Whether these were legitimate or bogus claims they will use them against you. Guest relations and customer service has access to the files and any leader can request information when dealing with a guest. If something seems fishy the magic file can be checked. And I saw a few vague references to "more to the story" on other sites. I wonder if he stays at Pop regularly and some of the CMs there know him. I do some customer service work and we definitely talk about a few repeat people who are difficult, or just weird. And we are ready to react a certain way just by seeing them. They may have been looking for something that clearly crossed the line so that they could pull out that stamp. And he provided it. The kind part of me would like them to revoke it after a while and for him to see this as a learning experience and benefit from it. If you can endure his videos, you will learn that he checked in on a Friday, and then starting around midnight, he had the following interactions with Disney on the very first night of his stay: 1. He called the front desk to complain of a chemical smell in his room. Since they wouldn't be in the room much, though, he said they could take care of it in the morning. I have to believe that there was more to this phone call than what he's saying. Did he ask them to give him a new room or make other demands?2. After that call, he makes another call to the front desk to ask about extending his stay by a day. This was after he had been told when he made the reservation and again at check in that there was no availability. He says he was on hold for over 15 minutes and thinks that he was hung up on.3. He calls the front desk again to complain about behind on hold for so long and being hung up on. This is when the "meth lab" comment is made (according to him). He also jokes around and asks if something happened to the fist CM he talked to. The CM on this call tells him someone will need to call him back.4. He gets a call back from a rude CM who tells him there is no availability.5. He decided to go to the gift shop before it closes to do some shopping (and have a smoke). While he's out, his wife calls him and asks him to get some extra pillows and towels for the room. He forgets. How did he forget? And why did the wife call him? Why didn't she call housekeeping? He says they're regular guests. They should know they're not going to hand over pillows at the front desk.6. After forgetting the pillows and towels, he goes down to the lobby to ask for them. (why didn't he or his wife call). The front desk CM tells him that they will send some up. Somehow, I have a hard time believing that he didn't at least ask about extending his stay or the chemical smell in his room when he had that opportunity.7. On the way back to the room, he decides to stop by the pool for another smoke. Here, he sees a security guard and waves to him. The guard doesn't wave back, so he waves harder. Again, what's the deal here? Why does he want the security guard to wave at him? And is there more to this story? Was he smoking someplace where he shouldn't be? Did he have some actual communications with security? He goes back to the room.8. Back at the room, a CM shows up with the requested pillows and towels, and isn't very nice.9. Everyone goes to sleep, but not for long, as there is a loud knock at the door from the Sheriff and security guards. The deputies look in the room, and confirm there's no meth lab. The duty manager issues the trespass warning.10. Mr. Swindle then breaks out the cell phone and wants to video the duty manager and deputies as he questions them. Somehow, I think Mr. Swindle made a nuisance and a pest out of himself, and probably was loud and confrontational with the CM's. Why else would they call out the sheriff? That's where I go back to, he should have waited for Disney's answer on revoking the ban before splashing this story all over the place and making it look like he was "wronged." Although if he does have a track record with Disney, I doubt any amount of begging or pleading will help. The majority of the comments I've seen don't seem to be leaning in his favor. Even on his own FB page, despite having a lot of "friends," there's almost no one liking or sharing any of the many posts he's made about this - most to do with the media coverage he's getting. Why would Disney chase away a paying customer? They had to have a good reason. TCD Now there's a very good point. We all know of lots of cases of Guests truly being unruly and disruptive to other Guests, and even doing things that may involve some liability. Heck, wasn't there an all our brawl at Epcot recently and those people weren't even kicked out of the park for the day! I'm sticking with "there's probably a LOT more to this story" -- that we may never hear about. Although if this guy continues to think social media is his friend, maybe we will. Actually, I am a little ashamed to admit that I made some observations based on the vehicle shown in the news clip, and the background of the fellow's video itself. I am somewhat familiar with the various neighborhoods in St. Augustine, as my in-laws lived there for years, my mom lives there now, and I spent a lot of time there when I lived in FL. There are some pretty iffy neighborhoods and a good bit of drug issues in certain parts of town (as in any town, but they used to have a pretty bad problem there). Anyway, I also questioned how someone who lived like that could afford APs and frequent trips staying on property…..that's the part I am not proud of, but now seeing the info you uncovered, it does look like they may be mis-managing their income somewhat. And, would explain why he believes he is owed something by Disney. I was just going to say this. The magic file. Every complaint is logged and tracked. A meth lab can be built many ways and sometimes within minutes. The larger more elaborate labs in hours. All methods are know to produce extremely hazardous gases and chemical compounds. Some of these gases and compounds are highly flammable and sometimes explosive. Why wait until the dead of night? Simple answer, less people around if things go bad. What we do not know is if adjacent rooms were evacuated or not. We also do not know the actions that were taken by police and staff of the resort. We know just what we are told and just like in the media, things are often distorted to serve a purpose. I would rather know that the staff and local law enforcement took all proper measures. He even shared one that he clearly didn't read that is in no way supportive or flattering, and contains a few choice 4 letter words. The only new article is one from Huffington Post where he says,' I don't know why I said 'meth lab.' This comment does make it sound like he really thinks he's in a battle with Disney, and that somehow if he tells his story to enough people, Disney will see the error of their ways and reverse the trespass order. As for the "apology" he mentioned before, this clarifies it a bit (also from the HuffPo article)... "This is not who Disney is," he said. "I'm writing a long letter to the higher-ups, and I think they will realize the lower-downs are making a mistake." A Disney spokesman told HuffPost that Swindler was asked to send a letter to security, asking to have his trespass removed, and that the company will review it. At this point, Swindler hasn't written the letter. "I think they've got their lines of communication mixed up," he told HuffPost. "I'd like an apology from the employees responsible, a refund for the night and maybe a stuffed toy for my daughters." So he hasn't even done the one thing Disney told him he can/should do to consider removing the ban - plead his case with Security - which is not an "apology" btw.
